Legislation combats the spread of non-consensual deepfakes online

On Monday, President Donald Trump signed the TAKE IT DOWN Act into law. The legislation aims to stop the spread of non-consensual intimate images (NCII), including deepfakes, online. The TAKE IT DOWN Act, which passed the Senate and House with near-unanimous support, becomes the first major law governing harms from generative AI. Leadership from ARI attended today’s signing ceremony.

“Today’s bill gives countless victims of abusive deepfakes a path to reclaim their identity online and stop the harassment. That’s a major victory,” said ARI President Brad Carson. “There’s growing demand among voters for lawmakers to address the impacts of AI, and the TAKE IT DOWN Act is a step forward. We need to harness this bipartisan momentum to tackle AI issues from national security to whistleblower protections to support for impacted workers.”

The TAKE IT DOWN Act criminalizes the publication of non-consensual, sexually exploitative images and requires digital platforms to remove NCII within 48 hours of notice. For more analysis on the TAKE IT DOWN Act and what it means for congressional action on tech legislation, read Brad Carson’s op-ed in Newsweek.

During Congress’s consideration of the TAKE IT DOWN Act, ARI brought over 30 groups together in support of the legislation, including coalitions of anti-trafficking and children’s advocacy organizations, grassroots advocates, and legal scholars.
